Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of X·ONE Care — the X·ONE warranty registration, product authentication and rewards application and website at xone.care (the “Service”). The Service is operated by X One Holdings Sdn Bhd (Company No. 1275339-D) (“X·ONE”, “we”, “us”, “our”). Please read these Terms carefully.

1. Acceptance of these Terms

By creating an account, accessing or using the Service, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

If you use the Service on behalf of an employer, dealer or other organisation — for example as retail staff or as a dealer — you represent that you are authorised to accept these Terms on their behalf, and “you” includes that organisation.

2. Definitions

  • Service — the X·ONE Care application, website and related features.
  • Account — a customer, staff or dealer account used to access the Service.
  • Product — an X·ONE product eligible for registration through the Service.
  • Warranty Registration — a record created in the Service linking a Product to a customer.
  • XP / Rewards — the promotional loyalty points and rewards offered through the Service.
  • Campaign — a time-limited promotional event run through the Service.

3. Eligibility & accounts

To use the Service you must be capable of forming a legally binding contract. You agree to provide accurate, current and complete information and to keep it up to date.

  • You are responsible for all activity that occurs under your Account.
  • Keep your password and account credentials confidential and secure.
  • Staff and dealer accounts are created and managed by the relevant dealer or outlet; access reflects the role assigned to you.
  • Notify us promptly of any unauthorised use of your Account.

4. The Service

X·ONE Care lets you register Products and warranties, verify product authenticity, file and track warranty claims, earn and redeem XP, and take part in Campaigns. We may add, change, suspend or remove features of the Service at any time.

5. Warranty registration & claims

Registering a Product in the Service records your warranty for convenience and reference. The actual warranty coverage, duration, conditions and exclusions are governed by the warranty terms supplied with the Product itself — not by these Terms.

  • Warranty claims are subject to validation. We and authorised dealers may request information or evidence (such as photographs) to assess a claim.
  • A processing or service fee may apply to certain claims. Where it does, the fee is shown to you before you proceed.
  • Decisions on the eligibility and outcome of a claim rest with X·ONE and its authorised dealers.
  • Claims found to be false, fraudulent or abusive may be rejected, and the Account may be suspended.

6. XP, rewards & campaigns

XP is a promotional loyalty unit. XP and rewards have no cash or monetary value, are not transferable, cannot be exchanged for money, and may expire in accordance with the programme rules shown in the Service.

  • We may adjust, expire, or discontinue XP, rewards and the rewards programme, in whole or in part.
  • Campaigns may carry their own additional rules, which prevail over these Terms for that Campaign. Prizes are subject to availability and to the Campaign rules.
  • We may withhold, reverse or cancel XP, rewards or prizes obtained through error, fraud, manipulation, or any breach of these Terms.

7. Acceptable use

You agree that you will not:

  • Register Products you do not genuinely possess, or create false or inflated activations;
  • Submit false, misleading or fraudulent warranty claims;
  • Manipulate Campaigns, leaderboards, referrals, check-ins or XP, or use any automated means, bots or scripts;
  • Reverse engineer, copy, scrape, or attempt to gain unauthorised access to the Service;
  • Impersonate any person, or misrepresent your affiliation with any person or organisation;
  • Upload unlawful, infringing or harmful content, or otherwise interfere with the Service or other users.

8. Staff & dealer use

Activations, claims and other actions performed through a staff or dealer Account are attributed to that Account, the staff member and the outlet. Staff and dealers must perform them honestly and only for genuine transactions.

  • Conduct may be reflected in merit scoring and other integrity measures within the Service.
  • Dealers are responsible for managing their outlets, teams and the access granted to staff.
  • Misuse of a staff or dealer Account may lead to suspension or termination of that Account.

9. Intellectual property

The Service, the X·ONE name and marks, and all related content and software are owned by X·ONE or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose. No other rights are granted.

You retain ownership of content you submit (such as claim photographs). You grant X·ONE a non-exclusive, royalty-free licence to use, store and process that content as needed to operate and provide the Service.

10. Third-party services

The Service may rely on or link to third-party services (such as maps for the store locator, or messaging providers). Those services are governed by their own terms, and we are not responsible for them.

11. Disclaimers

The Service is provided on an “as is” and “as available” basis. We do not warrant that the Service will be uninterrupted, timely, secure or error-free. The Service itself does not provide the Product warranty — warranty coverage is governed by the Product’s own warranty terms. To the fullest extent permitted by law, we disclaim all implied warranties.

12. Limitation of liability

To the maximum extent permitted by the laws of Malaysia, X·ONE will not be liable for any indirect, incidental, special or consequential loss, or for loss of data, loss of XP or rewards, or loss of profits or goodwill, arising from or related to your use of the Service. Our total aggregate liability arising from the Service is limited to the extent permitted by law. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

13. Indemnification

You agree to indemnify and hold X·ONE harmless from any claims, losses, liabilities and expenses arising from your misuse of the Service or your breach of these Terms.

14. Suspension & termination

We may suspend or terminate your Account or access to the Service if you breach these Terms, if we suspect fraud or abuse, or to protect the Service or other users. You may stop using the Service at any time. On termination, unredeemed XP and rewards may be forfeited. Provisions that by their nature should survive termination will survive.

15. Changes to the Service & Terms

We may update the Service and these Terms from time to time. Where changes are material, we will take reasonable steps to notify you. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

16. Governing law & disputes

These Terms are governed by the laws of Malaysia. You agree to submit to the exclusive jurisdiction of the courts of Malaysia. Where possible, the parties will first seek to resolve any dispute in good faith.
